Mark Law

One of the trappings of a globalized economy is that the protection of mark rights (company names and logos, trademarks, titles, domain names) assumes great strategic significance. Nowadays, even small and medium-sized companies are international, if not active worldwide, and so it is essential even for these companies to think at an early stage about international protection of the company name and of the particular trademarks so as not to be blocked when expanding their business. This is also seen against a background where in a few countries which are becoming more and more economically significant, more and more frequently trademarks are being filed "in bad faith" by specialist people or companies purely for the purpose of selling these tradmeark rights back to the actual propriertor. According to our observations, these activities are meanwhile extended also upon the company names and trademarks of medium-sized and small companies, clearly because it is assumed that these companies are not in the position, or are not willing to enter into expensive proceedings relating to immoral trademark applications. In addition, the Internet is presenting new challenges as regards trademark law, because the use of a company name or of a trademark on a company website cannot be restricted geographically.

Due to a higher than average proportion of mark right representations we have a great deal and wide range of experiences in all aspects of mark law. Along with our clients we develop strategies for the acquisition, implementation and defence of mark rights, both nationally and internationally. We also accompany our clients legally in the generation of mark rights and work together here with qualified partners. Moreover, we advise our client to design its website such that the potential risk of mark infringement occurring in foreign countries is restricted as far as possible. Moreover, in this area we are also capable of carrying out evaluations of trademark rights - be it for the acquisition of the latter or be it for the evaluation of hidden reserves.
